for all those people that go down the road to separation and finally divorce her are a few words of explanation to the workings of the family court law, viewed from the outside looking in.
fairness is a hard thing to understand , so family law is not about fairness as such as that is a difficult thing to make judgements about .
settlement is about an equitable division of assets. what is fair and what is not is too subjective an approach to the law. what i believe the court is trying to do is to produce an overall protective shield for all parties so that balance is the final outcome . so that each party receives a settlement that is balanced against their needs and their circumstances. an umbrella is created over the couple that are settling to ensure there is balance recreated in their lives.
